Jennifer Mills appeared on TV AM on Wednesday 17 July to discuss what rights employees have to take a 'mental health day'.

Can we take a mental health day as a sick day?

While there is no express mental health day entitlement incorporated within the Holidays Act, or indeed any other employment legislation an employee can rely on their sick leave or annual leave provisions.

At present this entitlement is five days per annum and can accrue to a maximum of 20 days.

There is no defined term for 'sick'.
